Service Specific Terms & Conditions (“SSTC”) – TV Offer

    1. The Plan(s): TV Offer
    2. You: Business Customer signing up for the Plan.
    3. The Plan(s) is not valid with any other offers and/or incentives, which have or may have been offered by Maxis under any other offers from time to time.
    4. The use of the Plan(s) is subject to the General Terms & Conditions (“GTC”), Service Specific Terms & Conditions (“SSTC”), Maxis Fair Usage Policy and any other applicable terms and conditions, all at https://business.maxis.com.my/en/terms-conditions/business/general/maxis-fair-usage-policy/.
    5. Capitalised terms herein have the same meaning as defined in the GTC.
    6. Your subscription of the Plan(s) is subject to the (i) Service Specific Terms & Conditions for Maxis Business Fibre at https://business.maxis.com.my/en/terms-conditions/business/plans/fibre/ (“Maxis Business Fibre SSTC”) and/or (ii) Service Specific Terms and Conditions for Maxis Business Postpaid & Fibre (“Maxis Business Postpaid and Fibre SSTC”) at https://business.maxis.com.my/en/terms-conditions/business/plans/postpaid-fibre/west-malaysia. Any conffict or inconsistency between this SSTC, the Maxis Business Fibre SSTC, the Maxis Business Postpaid and Fibre SSTC, the GTC and Summary Terms and Conditions (“STC”), shall be construed in the following order of precedence: (a) this SSTC; (b) the Maxis Business Fibre SSTC; (c) the Maxis Business Postpaid and Fibre SSTC; (d) GTC; and (e) STC.
    7. We reserve the rights without liability, to revise this SSTC, the Plan(s) and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaffets will be superseded. You accept that you are responsible for regularly reviewing information on the Plan(s), including changes to the Agreement. Your continued use of the Plan(s) (after the Effective Date of any revision/change to the terms and conditions of the Plan(s)) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same. If you do not accept such revisions/changes, you will terminate the Plan(s), subject to any Early Termination Charges (as defined below, if applicable)) by giving us notice within twenty-eight (28) days from the Effective Date failing which you are assumed to have accepted the changes.
    1. To be eligible for the Plan, you must either be an (1) existing or new Maxis Business Postpaid & Fibre customer, (2) or an existing or new Maxis Business Fibre customer.
      1. If you are an existing customer, you will need to upgrade your Maxis Business Fibre plan and recontract for twenty-four (24) months in order to be eligible for this Plan.
    2. Each eligible customer is allowed to purchase or sign up a maximum of one (1) TV device (“TV Device”) per Biz Fibre line as per the Appendix.
    3. Your eligibility is further subject to your compliance of our registration requirement and performance on credit check on you.
    4. You are ineligible for this Plan(s) if you owe us any payments.
    1. By accepting this Plan(s), you will enjoy TV Device at the monthly promotion price as offered by us, which is exclusive of all applicable taxes ("TV Offer Fee"). Please see the Appendix for the detailed TV Offer Fee.
    2. Your monthly TV Offer Fee shall remain unchanged even if you upgrade your Maxis Business Fibre and/or Maxis Business Postpaid & Fibre rate plan during the Commitment Period (as defined hereinafter).
    3. We will start charging TV Offer Fee from the first day of the Commitment Period.
    1. We shall not be responsible for any warranty claim for the TV Device. Please contact the manufacturer or its authorized repairer directly at MTT Solutions Sdn Bhd Customer Service Hotline: 012-969 6305 if the manufacturer’s warranty period for the TV Device has not expired.
    2. We will also not be responsible to replace the TV Device or any part thereof that is lost, stolen, damaged or defective (regardless such defect is a manufacturer defect or due to the reason of installation of the TV Device). You shall be responsible for the repair and maintenance of your TV Device at all times except where the repairs are still subject to the applicable warranty issued by the manufacturer.
    1. Billing for the Plan will commence on the Service Commencement Date (as defined under Maxis Business Fibre SSTC) of the Maxis Business Fibre service or the Maxis Business Postpaid & Fibre, whichever is applicable (“Service Commencement Date”).
    1. The minimum commitment period of this Plan(s) is twenty-four (24) months from the Service Commencement Date ("Commitment Period"):
    2. You shall not, during the Commitment Period:
      1. terminate your Maxis Business Fibre or Maxis Business Postpaid & Fibre rate plan, whichever is applicable or
      2. terminate or suspend your account or port out to another Internet service provider; or
      3. have your account terminated for non-payment of monthly bills; or
      4. change or transfer ownership of your account and/or the Plan(s) to any person; or
      5. downgrade your Maxis Business Fibre or Maxis Business Postpaid & Fibre rate plan, whichever is applicable to the rate plan below your entry rate plan; or
      6. upgrade your Maxis Business Fibre or Maxis Business Postpaid & Fibre rate plan.
    3. You acknowledge that, if any of the above event occurs, this Plan(s) will be terminated, and you shall be liable to pay us the early termination charges for Maxis Business Fibre or Maxis Business Postpaid & Fibre plan, whichever is applicable. In addition, you shall pay us the early termination charges for the TV Device calculated as follows (“Early Termination Charges”):[(TV Device(s) Recommended Retail Price (RRP) ÷ 24 months)] x Remaining month(s)]
    4. Payment of the TV Device for the Early Termination Charges is without prejudice to collection of all monies owing to us by you in accordance with your account up to the time of early termination. You will be responsible for all outstanding amounts which will be due and payable by you to us immediately on the date of your billing cycle. All outstanding amounts due and owing to us shall be subject to applicable taxes. If you suspend your Maxis Business Fibre or Maxis Business Postpaid & Fibre plan, whichever is applicable during the Commitment Period, the TV Offer Fee will continue to be charged to you.
    5. You accept and acknowledge that the TV Device title and ownership does not belong to you during the Commitment Period. You are accountable for the use and safety of the TV Device. Nothing in this SSTC shall be construed as transferring the title or ownership of the TV Device to you unless otherwise expressly stated. You shall not directly or indirectly give or allow another person to give any interest in or lien over the TV Device. You shall promptly, at your own costs and expenses, take all such actions as may be necessary to duly discharge or eliminate any such liens over the TV Device upon obtaining actual knowledge thereof.
    1. The TV Device will be delivered to your doorstep (following Maxis Business Fibre or Maxis Business Postpaid & Fibre installation address) for free, unless otherwise stated by us to you. You acknowledge that the TV Device may not be available for immediate delivery. You will receive a call from our delivery partner within ten (10) business days from the Service Commencement Date for delivery appointment. Delivery slots are subject to availability.
    2. Your authorized signatory will need to present his/her original NRIC or passport used during sign-up to our delivery partner or passed the identity verification check conducted by our delivery party upon delivery.
    3. Your authorized signatory may assign representative to collect on behalf as per stated in Registration Form.
    4. We cannot and will not accept responsibility for failure or delay of delivery of the TV Device by our third-party delivery partner.
