Service Specific Terms & Conditions (“SSTC”) – Maxis Business Postpaid & Maxis Business 4G WiFi 138

- The Plan(s): Maxis Business Postpaid & Maxis Business 4G WiFi 138
- You: The Business Customer signing up for the Plan(s).
- If you change your current rate plan to the Plan(s), you will not be able to carry forward any promotions/ benefits that you are currently enjoying under your existing rate plan to the Plan(s).
- The use of the Plan(s) and Service(s) is subject to the General Terms & Conditions (“GTC”), Service Specific Terms & Conditions (“SSTC”), Maxis Fair Usage Policy and any other applicable terms and conditions, all at https://www.business.maxis.com.my/terms-conditions/business/.
- Capitalised terms herein have the same meaning as defined in the GTC.
- Any conflict or inconsistency between this SSTC, the GTC and Summary Terms and Conditions (“STC”), shall be construed in the following order of precedence: (a) SSTC; (b) GTC; and (c) STC. Further, the Maxis Business Postpaid plan under the Plan(s) is subject to SSTC – Maxis Business Postpaid (https://www.business.maxis.com.my/en/mobile-plans/postpaid-plan-s/) and the Maxis Business 4G WiFi 138 plan under the Plan(s) is subject to SSTC – Maxis Business 4G WiFi 138 plan https://www.business.maxis.com.my/en/terms-conditions/business/. For clarity, any conflict or inconsistency between this SSTC, SSTC – Maxis Business Postpaid and SSTC – Maxis Business 4G WiFi 138 plan, this SSTC shall take precedence.
- We reserve the rights without liability, to revise this SSTC, Plan(s) and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on the Plan(s) and Service(s) at https://www.business.maxis.com.my/terms-conditions/business/, including changes to the Agreement. Your continued use of the Service(s) and/or Plan(s) (after the Effective Date of any revision/change to the terms and conditions of Services and/or Plan(s)) shall constitute unconditional acceptance by you of such revisions/changes and you shall be bound by the same. If you do not accept such revisions/changes, you will terminate the Plan(s) and/or the use of the Services by giving us notice within twenty-eight (28) days from the Effective Date failing which you are assumed to have accepted the changes.

- To be eligible for this Plan(s) you must be a Business Customer.
- You are ineligible for this Plan(s) if there is any outstanding payment due to us.
- This Plan(s) is inapplicable to you if you are a commercial user and/or bulk subscriber. The provision of Service(s) is contingent on your Premises being-fibre ready and having a termination point within the Premises.

- The Plan(s) structure and applicable Charges is in the appended Appendix and also published on our official website at https://www.business.maxis.com.my as updated by us from time to time. Charges published are exclusive of all applicable taxes.
- The applicable Charges and rate is as set out on our official website at https://www.business.maxis.com.my/mobile/postpaid-plan/. Charges published are exclusive of all applicable taxes.

- Non-payment for any one of the Service package may result in suspension or barring of all the Services until the outstanding amount is paid.

- We reserve the rights at any time, without being liable to you or any third party, to interrupt, bar, suspend, restrict the Service(s) for such time as we see fit or terminate, discontinue or disconnect the Service(s) if your usage:
- Shows excessive usage or placing unusual burdens on our Network;
- Is for unlawful activities or for suspected fraudulent activities;
- Is not in accordance with the Maxis Fair Usage Policy (at https://www.business.maxis.com.my/terms-conditions/business/general/maxis-fair-usage-policy/); or
- Is for commercial/non-personal purposes.
- We reserve the rights at any time, without being liable to you or any third party, to interrupt, bar, suspend, restrict the Service(s) for such time as we see fit or terminate, discontinue or disconnect the Service(s) if your usage:

- For data allocated with the Plan(s), you acknowledge and accept:
- If the combined mobile data usage of your principal line and your shared lines exceed 300GB in a month, Maxis may at its absolute discretion limit the quality of video streaming to standard definition during peak hours.
- The mobile internet package allocated within the Plan(s) is exclusively for domestic usage only.
- You can opt for upgrades or downgrades at any Maxis Service Centre or Maxis Exclusive Partners (MEP) or our Contact Centre's (1919).
- If you upgrade or downgrade to another Maxis Business Postpaid plan, your monthly commitment fee will be pro-rated against your billing cycle date. You will be charged the full commitment fee from the second month onwards but with full mobile internet package allocation from the first month.
- For data allocated with the Plan(s), you acknowledge and accept:

- The rates outlined in the Plan(s) structure (as per the Appendix) do not account for usages while on an overseas roaming network. Whilst roaming overseas, the prevailing data roaming charges at https://www.business.maxis.com.my/mobile/international-roaming/ apply.

- You will only be able to enjoy the benefits of the Plan(s) (as per the Appendix) after the activation of your subscribed Maxis Business Postpaid and Maxis Business 4G WiFi 138 plan. For clarity:
- if for any reason, your subscribed Maxis Business Postpaid plan and/or Maxis Business 4G WiFi 138 plan under the Plan(s) fails to be activated or installed, you are deemed not to have been registered for the Plan(s);and
- If either of your subscribed Maxis Business Postpaid plan or Maxis Business 4G WiFi 138 plan is successfully activated or installed, you are deemed to have been registered for the respective plans.
- Upon registration for the Plan(s), your Maxis Business Postpaid plan and Maxis Business 4G WiFi 138 plan must be kept active and not suspended during the minimum contract period if you want to enjoy the benefits of the Plan(s).
- Maxis reserves the right to downgrade your Plan(s), which removes all benefits of such Plan(s), if you suspend your Maxis Business 4G WiFi 138.
- Upon subscription to the Plan(s), you are eligible to enter into selected device contracts with us, which are subject to the respective device contract terms and conditions. Subscription to the Plan(s) does not affect your existing device contracts with us. Upon subscription to each Plan(s), you are only entitled to nominate a maximum of eight (8) lines to enjoy the unlimited data quota (as per the Appendix).
- You will only be able to enjoy the benefits of the Plan(s) (as per the Appendix) after the activation of your subscribed Maxis Business Postpaid and Maxis Business 4G WiFi 138 plan. For clarity:

- Subject to our GTC, a principal line holder may at any time terminate the Plan(s) as follows:
- by calling our customer care line at 1-800-82-1919 or dial 1919 from your mobile;
- by walking into our Maxis Centre's listed on www.maxis.com.my; or
- by writing in to customercare@maxis.com.my or bizcare@maxis.com.my.
- Your Plan(s) will be terminated if you make any changes to your plan other than an upgrade.
- Upon termination of your Plan(s), all benefits under the Plan(s) will automatically ceased to be applicable.
- For any planned interruption of Service(s), adequate notice will be provided via a valid mobile number and/or any other mode of communication as we may deem appropriate.
- Subject to our GTC, a principal line holder may at any time terminate the Plan(s) as follows:
APPENDIX
You are entitled to sign up for the following:
- One (1) eSMS service free of charge for 24 months for each Plan(s);
- One (1) Maxis Business VoiceGo service free of charge for 24 months for each Plan(s); and
- One (1) Secure Mobile free of charge for 24 months for each Plan(s) (Eligible for MBP 128 and above).

- The Plan: Maxis Business 4G WiFi 168
- The Service(s): Comprises of the Maxis Business 4G WiFi 168 plan. It applies to local data usage, voice services and IDD Calls. Roaming data usages and additional services as subscribed by you shall be charged in addition to the Plan’s applicable charges.
- You: The Business Customer or/and employees or contract staffs of a Business Customer signing up for the Plan.
- The use of the Service(s) is subject to the General Terms & Conditions (“GTC”), Service Specific Terms & Conditions (“SSTC”), Summary Terms & Conditions (“STC”), Maxis Fair Usage Policy and any other applicable terms and conditions, all at https://www.business.maxis.com.my/terms-conditions/business/.

- Any conflict or inconsistency between this SSTC, the GTC and the STC, shall be construed in the following order of precedence: (a) SSTC; (b) GTC; and (c) STC.

To be eligible for this Plan and Service(s), you must:
- Be our Business Customer;
- Not have any outstanding payments with us; and
- Not be a commercial user and/or bulk subscriber.
- The Plan is available with a Mobile Device or SIM only plan.

- The applicable Charges and rate table guide for the Plan is as set out on our official website at https://www.business.maxis.com.my/en/plans/4g-wifi/. Charges displayed do not include all applicable taxes and GST .
- A deposit of RM500 is chargeable for non-Malaysian’s subscribing to the Plan and Service(s).
- Your bills are available in electronic format if you sign up for E-Billing service via Maxis Online Account or Maxis Business Hub and a copy will be sent to your.

- The Service(s) will be activated within twenty-four (24) hours from registration (“Activation”).
- For the Plan(s) with a Mobile Device, you are entitled to enter into a contract for a minimum period (“Minimum Period of Service”) of either:
- a twelve (12) months from the date of Activation; or
- a twenty-four (24) months from the date of Activation.
- You may be charged early termination charges should you terminate your Plan before the end of either your twelve (12) or twenty-four (24) months contract. The early termination charge is calculated based on: Monthly commitment x remaining months of the Minimum Period of Service.
- The Service(s) will be activated within twenty-four (24) hours from registration (“Activation”).

- You acknowledge and accept, that the following shall apply with regards to the minutes allocated to you for Voice calls and IDD calls under the Plan:
- Domesticmobile/fixedON-net(MaxistoMaxiscalls)&OFF-net(callsfromMaxistootherServiceProvider)usage(excluding,videocalls,callstospecialnumbers, eg.1-300/1-800/600, 121, TM100, 1MOCC, 02-pre_x numbers for IDD calls to Singapore & 080-pre_x numbers for border calls to Brunei) & Unity Hotline;
- are for standard person to person calls;
- it is NOT meant for video calls, multiple simultaneous calling, conference calling, re-supply, call centre usage, telemarketing, bulk messaging, application-to-person communication, continuously call forwarding, auto-dialing, machine-to-machine communication (including by using your SIM card in any other devices), Cellular Trunking Units (CTUs), or any other activity we consider to be non-standard usage .
- You acknowledge and accept, that the following shall apply with regards to the minutes allocated to you for Voice calls and IDD calls under the Plan:

- You acknowledge and accept, that the following shall apply with regards to the minutes allocated to you for IDD calls under the Plan:
- Under the Plan, Customers shall be provided with one-hundred and twenty (120) minutes for IDD calls;
- IDD calls shall only be applicable to the following countries: Cambodia, China, HongKong, India, Indonesia, Japan, Myanmar, Pakistan, Philippines, SaudiArabia, Singapore, Sri Lanka, South Korea, Taiwan, Thailand, and Vietnam;
- In the event that your allocated minutes are completely utilized, you will be charged our standard IDD rate listed at https://www.business.maxis.com.my/en/plans/idd-saver/
- The Plan and Service(s) speed is on a best efforts basis. The typical average speed for the 4G LTE network is between 10 to 30Mbps.
- We reserve the right at any time, without being liable to you or any third party, to interrupt, bar, suspend, restrict the Service(s) for such period of time as we deem fit or terminate, discontinue or disconnect the Service(s) if your usage:
- shows excessive usage or placing unusual burdens on our Network;
- is for unlawful activities or for suspected fraudulent activities; or
- is not in accordance with Maxis Fair Usage Policy (at www.maxis.com.my/FUP).
- The SIM card allocated to you for the Service(s) can be used with the Mobile Device provided or other mobile devices.
- For every subscription of the Plan(s) and Service(s), you have the option to purchase a Dect Phone, as follows:
- If you subscribe to a twelve (12) or twenty-four (24) months contract and choose to purchase a Dect Phone, you will not be charged a one-time fee.
- You acknowledge and accept, that the following shall apply with regards to the minutes allocated to you for IDD calls under the Plan:

- Total Internet quota for each Plan(s) is specified during point of sales as contained in the sales material and the rate table on our website at https://www.business.maxis.com.my/en/plans/4g-wifi/.
- For data allocated with the Services(s), you acknowledge and accept:
- If your data usage exceeds 300GB in a month, Maxis may at its absolute discretion limit the quality of video streaming to standard definition during peak hours.
- The mobile internet package allocated within the Services(s) is exclusively for domestic usage only.
- There is no guarantee of speed. Availability of service depends on Mobile Data Coverage.
- Total Internet quota for each Plan(s) is specified during point of sales as contained in the sales material and the rate table on our website at https://www.business.maxis.com.my/en/plans/4g-wifi/.

- The Mobile Device provided under the Service(s) are:
- on a “while stocks last” basis;
- subject to the suppliers terms and conditions; and
- comes with a one (1) year warranty.
- We reserve the rights to change the modem model from time to time.
- The one (1) year warranty does not cover:
- The SIM and Mobile Device holder;
- Damage, loss or defects caused by any act, omission, misuse, negligence including usage of the modem contrary to instructions provided by Maxis or the manufacturer (as set out in the Mobile Device user guide); and/or
- Other acts beyond our reasonable control.
- Please visit your nearest Maxis Centre should you have any issues with the Mobile Device.
- If you have any issues with the Dect Phone, please visit the Phillips Service Centre.
- If you discontinue the Service(s) before the expiry of the Minimum Period of Subscription of either twelve (12) or twenty (24) months, you do not need to return the Mobile Device to us. However, you will be charged with the early termination charges as stated in Clause 14.
- The Mobile Device provided under the Service(s) are:

- The rates outlined in the Plan(s) structure do not account for usage while on an overseas roaming network.
- Data roaming service(s) are available for the Service(s). You will be charged RM10 per day if you opt in for the data roaming service while roaming in these nine (9) countries – Singapore, Indonesia, Thailand, Myanmar, Brunei, Phillippines, Vietnam, Cambodia and Laos.
- Your local data quota will be utilised according to the Plan(s) you have signed up for.
- Whilst roaming overseas (other than the eight (8) countries mentioned above), the prevailing data roaming charges at https://www.business.maxis.com.my/en/plans/international-roaming/ will apply.

- Subject to the GTC, you may at any time terminate the Plan(s) by giving us at least thirty (30) days’ prior written notice by writing in to customercare@maxis.com.my or bizcare@maxis.com.my.
- For any planned interruption of the Service(s), Maxis will provide you adequate notice via notice on our official website at https://www.business.maxis.com.my/en/plans/4g-wifi/ and/or any other mode of communication as we may deem appropriate.
